Form I-601A lets certain immigrant visa applicants in the U.S. seek a waiver of the 3- and 10-year unlawful presence bars before leaving for the consular interview. Prima.Law builds the hardship case.
Applicants 17 or older, in the U.S., with an immigrant visa case pending with DOS, whose only inadmissibility ground is unlawful presence.
Refusal must cause extreme hardship to a U.S. citizen or LPR spouse or parent. The applicant must also merit a favorable exercise of discretion.
A paper filing mailed to a USCIS lockbox with a DOS immigrant visa fee receipt showing PAID. A receipt showing In Process is not accepted.
The waiver takes effect only after departure and a consular finding that the applicant is otherwise admissible. It grants no status or work permit.
Form I-601A lets certain immigrant visa applicants who are physically present in the United States ask USCIS to waive the 3- and 10-year unlawful presence bars under INA 212(a)(9)(B) before they leave for the immigrant visa interview abroad. The bars are triggered by the departure itself, so the applicant learns whether USCIS will waive them before leaving.
An approved provisional waiver takes effect only after the applicant departs, attends the interview, and the consular officer finds the applicant otherwise admissible. It covers unlawful presence only. It grants no status, work authorization, advance parole or protection from removal, and it is revoked if the officer finds another ground or the applicant reenters without inspection.
A denial cannot be appealed and no motion is available, but the applicant may file a new Form I-601A while the DOS case is pending, or file Form I-601 after the interview if DOS finds the applicant inadmissible.
The unlawful presence bars under INA 212(a)(9)(B) apply when a person accrues more than 180 days of unlawful presence, departs, and then seeks admission again within the relevant period. More than 180 days but less than 1 year triggers the 3-year bar. One year or more triggers the 10-year bar.
Because the bar attaches on departure, applicants who cannot adjust status in the United States and must attend an immigrant visa interview abroad become inadmissible when they leave. The USCIS Policy Manual notes that a trip on an Advance Parole Document is a departure for inadmissibility purposes.
The applicant files Form I-601A with USCIS before departing, with evidence of the qualifying relationship, the relative's status, extreme hardship and discretion. If USCIS approves, the applicant attends the interview, and the waiver takes effect if the officer finds no other ground.

The I-601A needs a PAID DOS fee receipt, and the client should not leave for the interview before USCIS decides, so NVC steps must line up.
How Prima.Law helps: DS-260 data is prepared once in Prima.Law and the Chrome extension autofills it on CEAC, so a slow or timed-out CEAC session is resent, not retyped, while case flow items track the waiver.
Separation and economic loss alone generally do not reach extreme hardship, so firms need medical, financial and country evidence for the relative.
How Prima.Law helps: The detailed, proven I-601A checklist, created by active immigration lawyers, lists hardship evidence by factor. Clients upload to it in the portal, and staff mark each item complete.
Families wait a long time for a decision and worry about leaving too early, which would trigger the bar with no waiver in place.
How Prima.Law helps: USCIS receipt tracking alerts the team when the I-601A status changes, the portal shows the status to the client, and two-way texting from the firm's number keeps every update in the case file.
