DACA Requests (Form I-821D)

DACA requests pair Form I-821D with Forms I-765 and I-765WS. Prima.Law keeps renewals on schedule and evidence organized while court orders limit what USCIS processes.

Initial Requests

USCIS will continue to accept initial requests but will not process initial DACA requests at this time, after the Jan. 17, 2025 Fifth Circuit decision.

Renewals

USCIS will continue to accept and process DACA renewal requests and accompanying applications for employment authorization, pursuant to the court's order.

Key Forms

Form I-821D, Form I-765 and Form I-765WS, filed together. USCIS states that the fees for these forms cannot be waived.

Existing Grants

Current grants of DACA and related EADs remain valid until they expire, unless individually terminated, according to USCIS.

General Guidelines for DACA

Deferred Action for Childhood Arrivals defers removal action for a set period for certain people who came to the U.S. as children. Requests use Form I-821D with Form I-765 and Form I-765WS. USCIS may grant DACA only if each threshold guideline is met and a favorable exercise of discretion is warranted.

Under current court orders, USCIS will continue to accept initial requests but will not process initial DACA requests at this time. USCIS will continue to accept and process DACA renewal requests and accompanying applications for employment authorization. Current grants of DACA and related EADs remain valid until they expire, unless individually terminated.

Common Pain Points in DACA Cases

Renewal Windows Slip By

USCIS strongly encourages renewals 120 to 150 days before the I-797 expiration date, and busy firms can lose sight of who is due.

How Prima.Law helps: Saved views and filters on the Case Management Board keep every DACA renewal in one list, and the Receipts hub alerts staff when a request's USCIS status changes.

Years of Residence Proof to Rebuild

Requests rest on proof of arrival before age 16, residence since June 15, 2007 and presence on June 15, 2012, spread across schools and jobs.

How Prima.Law helps: The DACA checklist, created and maintained by active immigration lawyers, lists each type of proof. Clients upload records in the portal and staff mark items complete as they come in.

USCIS Online Sessions Time Out

Form I-821D and the DACA I-765 can be filed online, but slow pages and outages can force staff to retype addresses and history.

How Prima.Law helps: Prepare the data once in Prima.Law and the Chrome extension autofills the USCIS online forms. If the site is slow or goes down, the data stays safe in Prima.Law and is sent again, not retyped.
