USCIS Unveils Updated Form I-485: What Green Card Applicants Need to Know

On December 10, 2024, U.S. Citizenship and Immigration Services (USCIS) released a revised version of Form I-485, Application to Register Permanent Residence or Adjust Status, introducing significant changes that will impact all green card applicants filing for adjustment of status.

Key Changes to Form I-485:

1. Mandatory Submission of Medical Examination Results:

Effective December 2, 2024, applicants are required to submit Form I-693, Report of Immigration Medical Examination and Vaccination Record, concurrently with their Form I-485. This change aims to streamline the application process and reduce delays. Failure to include Form I-693 may result in the rejection of the I-485 application.

2. Simplified Affidavit of Support Exemption Process:

USCIS has integrated the request for exemption from submitting an Affidavit of Support directly into Form I-485, eliminating the need for the separate Form I-864W. This modification simplifies the process for applicants who qualify for an exemption.

3. Enhanced Public Charge Assessment:

The updated form includes clearer questions regarding the public charge ground of inadmisg applicants to specify their immigrant category. This addition assists USCIS in efficiently determining public charge exemptions, aiming to reduce confusion and expedite the adjudication process.

Important Deadlines:

Starting February 10, 2025, USCIS will accept only the new edition of Form I-485, dated 10/24/24. Applicatng older versions after this date will be rejected. Applicants should ensure they are using the latest form version to avoid delays.

Implications for Applicants:

Medical Examination Timing: Applicants must complete their medical examination before filing Fresults must be included with the initial submission. This change eliminates the previous practice of submitting Form I-693 later in the process, often in response to a Request for Evidence or during the I-485 interview.
